Then, as Mitch and Naomi did every winter, the family downshifted into a normal lifestyle, which meant days in school for the kids, shopping, sex, gambling, and relaxation for Mitch and Naomi, and just unwinding. The jury and judge heard the case day after day, and the tension mounted. Finally, by the second week in Dec, all testimony was over, and the case was given to the jury. The outcome could be anything of many varying scopes. The jury could find that the team violated laws and Alan had the right to mandate the tickling situation, forcing an end to the parties. There could be a finding of a violation of civil rights on Alan's part, forcing him to sell the team and get out, or there could be other findings. At last, three days before Christmas, after more than a week of deliberating, the jury handed down it's verdict. The jury found that Alan had in fact violated the civil rights of the team by attempting to regulate their off field activities, and personal lives, and had to cease and desist at once. However, the team did not have Alan out of their lives just yet, in spite of the win. The jury also found that Alan still, in spite of his violation of their rights, had not violated any baseball laws, and would not have to be suspended or give up the team. Instead, an unusual compromise was worked out. Alan was allowed to maintain a silent financial interest in the team for investment purposes, and would have no discretion of team policy or team activities. Further, a buyer would be found to partner with Alan in the team. This buyer would serve as managing day to day operator of the team, and before purchasing the team, would in turn sign an ongoing, written agreement, which stated clearly that as long as all players abided by baseball rules and laws of society on the field and in regard to drugs, the owner could not, and would never, attempt to regulate, litigate, or tamper with any team fetish activities off the field. It was essentially a win- win situation. Alan still had his financial interest in the team, and the players had him out of their lives. He would still be allowed to attend games, but only for financial or entertainment purposes, and could not enter the clubhouse, harrass the players, or make any personnel changes.
