Clip Tading (Not actual tading, just a thought/question)

I was discussing this with a few friends earlier and I'm wondering what you guys come up with.

What's the problem with clip trading?

I'm not talking about posting them on youtube, but honest to goodness trading. Last I knew purchasing something pretty much meant i was my property. I mean, if I buy a DVD I could trade it to a friend for pretty much anything and I do not know of any legal ramifications.

I can understand not using forums to do it, but is there anything wrong?

Also, I haven't heard of anyone causing a fuss over the lots on ebay every now and then of old dvd/vhs tapes. If the argument for that is that purchased online clips (ie. anything bought off of clips4sale) are easier to copy/distribute, it's extremely easy to rip dvd's onto a computer. And ll you need are 2 vhs players and you can copy one tape to another

I guess I'm really wondering if there is anything legal that prevents someone from trading clips or if it's just something producers put on the end (like at the end of realtickling's and t2d's clips)?
 
The main problem with your argument of Clip trading being comparable to say, trading a dvd, is that with the dvd there is only ONE copy per purchase. You have the dvd, you give the dvd to your friend, and you no longer have the dvd. With clip trading you are effectively copying the clip and giving a copy to your friend. You BOTH end up with the clip. That's a big no-no, with both dvd's and clips. If it were legal, a large database of all the pay clips could be opened, and I'm sure that the producers of all that wonderful material wouldn't appreciate the loss in profits! Just my 2 cents.
 
TG (a1352b) is correct. Clips are not something you can physically give away and then have no further way to use or view; they can be easily copied or, after trading, retrieved from a hard drive even if deleted. I'll quote a bit on the "First Sale Doctrine" that Mistress Valerie posted elsewhere:

The first-sale doctrine is a limitation upon copyright that was recognized by the U.S. Supreme Court in 1908 and subsequently codified in the Copyright Act of 1976, 17 U.S.C. § 109. The doctrine of first sale allows the purchaser to transfer (i.e. sell or give away) a particular, lawfully made copy of the protected work without permission once it has been obtained. That means the distribution rights of a copyright holder end on that particular copy once the copy is sold." The term "copy" means the original instance of the material on tangible media, such as the original DVD or VHS tape.
