Not sure how I feel about this. I don't think anyone should be using a phone while driving, but is the sender of the message liable in any way for something like this? What do you all think?

My understanding is that if you through negligence or recklessness cause an accident in which significant injury or death occurs, you can be sued.

Have radio stations and makers of 8-track, cassette, cd, MP3 players etc been sued for distracting drivers? What about all the artists that perform and sponsors that advertise on these potentially distracting medias? Of course listening to these while driving on long stretches of road at night has helped keep people awake at the wheel. What about the dudes that invented mini-skirts and halter tops and breast implants? His taking the call/text while driving was the problem.

Exactly. This is just another case of a ratty lawyer trying to pass the book from his client to someone else, and it's even more ridiculous considering his client didn't even get their license suspended: how much more lenient does he want the judge to be? As someone who has been involved in a car crash which was caused by someone using their phone, this really pisses me off.
