i'm selling my ipod with the videos. so i can only sell it once, its not like i'm copying the videos and reselling many times to make money. i just thought that since this is a tickling forum, someone in need of an ipod would like to buy it with the tickling videos included.
It doesn't matter if it's only one copy of each video. I'll grant you that it's not as bad as reselling several copies, but I still believe it's illegal. You can't justify doing something illegal by using the argument that it's "just for this one time".
My position is that no electronic version of a video can be considered an original version that can legally be resold or given away. Only physical videos. I mean, how can one tell that a clip is the original? It doesn't matter if you know you bought it directly from a vendor. It still doesn't have a tangible existence that proves it's an original. I actually have a hard time accepting that there is such a thing as an original copy of a clip. If there is one, then it's the copy that the vendor created in the first place, and what the customers buy are all just copies that can't be resold or transferred to someone else.
I think that when you buy a clip, you don't actually buy the clip so much as the right to view it (and keep it stored on your hard drive, DVD-R or whatever, as long as you're the only one who watches it). If someone else is to watch it, he needs to buy it. It's kind of like buying a bus pass. Yes, you do get a physical card, but what you're actually paying for is the right to ride the bus. The pass only shows that you paid. It would be easy to let a friend use the pass, but if he didn't pay for his own, then it's technically illegal.
Then again, I'm not fully aware of the legal technicalities. However, here's something I found on the Clips4Sale.com website:
"Unauthorized copying, sharing, distribution, reproduction, or any other use is a violation of applicable laws. All clips sold are to be viewed by the purchaser only and are not to be shared, traded or posted for others to download. Violators will be prosecuted to the fullest extent of the law. There is to be no re-sale of any merchandise, videos, video clips, or pictures purchased from any Clips4sale.com site without written consent from Clips4sale.com."
Personally, I feel that written consent should be obtained from the producers, and not from Clips4Sale. After all, the material belongs to them, not C4S. I also disagree with the idea that an original physical video can't be resold or given away. I don't really like it, but I think it's ok. But otherwise I very much agree with what they say about clips.
I appreciate the thought of selling your iPod with the videos to someone from the forum who might enjoy them, but I personally believe that the only right way to do it is to delete the videos before selling your iPod.
