ROCKVILLE CENTRE, N.Y. — A New York man says he didn't know it was a crime to laugh.

Robert Schiavelli of Rockville Centre, on Long Island, was slapped with two summonses for "disturbing the peace."

Police responded to his home on Feb. 12 and Feb. 13 after receiving complaints from his next-door neighbor that his loud laughs could be heard across the driveway.

The 42-year-old was charged with acting "in such a manner as to annoy, disturb, interfere with, obstruct, or be offensive to others."

At his arraignment Tuesday, a judge declined to dismiss the charges.

Schiavelli tells the New York Post his neighbor often taunts him due to his disability. He deals with it by laughing him off.

Schiavelli suffers from seizures and neurological impairments.

The neighbor didn't respond to requests for comment.

Well damn... hope you NY members keep your windows closed and ball gags firmly in place. Beats getting a $250 fine or 15 days in jail.

He has brain damage and the neighbor has repeatedly taunted him for it? If that's true, the neighbor is a huge dick.

Assuming the linked article is true, the neighbor is an ass of the first order. As to the ticket this man recieved...

This whole situation seems absurd. The guy who is taunting his disabled neighbor by laughing at him is a jerk. Also, if the guy with the disability finds laughing helps him deal with the ridiculing, so what?

Were I a judge in this case, I'd tell the guy who is ridiculing the disabled guy "Cut it out, you're a jerk". As for the disabled guy himself, I'd probably say "Okay, if he stops taunting you, try to control it with the loud laughing".

Its a good thing none of us lees on this forum live in this neighborhood. Imagine if someone ticketed one of the forums lees for "laughing too loud while being tickled". We might have a judge tell us to stop it or curb the tickling.
