signed waiver for dessert

Just heard on the local news how some restaurants that sell really rich and decadent desserts actually have waivers for customers to sign so the restaurant isn't held respondsible for customers getting fat!
This stems back from the McDonalds lawsuit earlier this year where a family tried to sue when their child got fat from eating McDonalds food.
I can't believe we've reached this point in our society. Does this mean I can sue Deep Purple, Led Zeppelin, and Van Halen for loss of hearing when I use to crank up their 8-tracks years ago?

Now granted, I'm only 25 and haven't exactly got a ton of experience to base this observation on, but when the heck did we loose the ability to apply common sense to the world? Seriously, I work in the computer field and when I see the 'new blood' coming into the field from school and university I'm absolutely terrified at the thought that this lot are meant to be the future. Somewhere along the line the idea of applying the brain in a given situation and coming up with a solution that you haven't route-memorised before hand has been consigned to the history books, right alongside any sense of social or moral responsibility or independent thought.

Hey, hang on, that's the answer! If McD's can be sued for causing weight gain, let's all file suit against the governments of the western world for not teaching kids the basic skills needed to deal with life! Come on, it's no more stupid than someone not realising their coffee might be hot before drinking it (didn't they actually win that one?).
