Okay...those with the gold make the rules.

http://www.usatoday.com/story/news/nation/2014/02/05/no-jail-for-teen/5242173/

In a case with growing political ripples, a Texas judge's reaffirmation placing a teen involved in a drunken-driving fatal accident on probation is drawing fresh outrage from the victims' families.

Ethan Couch, 17, will be on 10 years probation after Texas District Judge Jean Boyd again decided against jail time. He'll also be in a drug and rehab center for an unspecified time. Couch's attorneys used an "affluenza" defense at his trial last year, saying the then 16-year-old had grown up with a sense of entitlement and developed poor judgment after being coddled by his wealthy parents.

Prosecutors said Couch's blood-alcohol level was three times the Texas legal limit when his pickup slammed into a group of people who were helping a woman with a stalled car last June. The driver, Breanna Mitchell, and bystanders Brian Jennings, Hollie Boyes and daughter Shelby, were killed. Nine others were injured.

I take it he wouldn't last 10 seconds in the pokey. This is the best justice money can buy.

More like injustice... in my opinion. And vehicular homicide isn't a white collar crime - so his punishment should fit his age and actions. Sorry, break the rules and there should be the same consequences whether you're black, white, rich, or poor.

Just a little La Fontaine (kind of like the French version of Aesop):

The Animals Sick of the Plague.

The sorest ill that Heaven hath
Sent on this lower world in wrath,--
The plague (to call it by its name,)
One single day of which
Would Pluto's ferryman enrich,--
Waged war on beasts, both wild and tame.
They died not all, but all were sick:
No hunting now, by force or trick,
To save what might so soon expire.
No food excited their desire;
Nor wolf nor fox now watch'd to slay
The innocent and tender prey.
The turtles fled;
So love and therefore joy were dead.
The lion council held, and said:
"My friends, I do believe
This awful scourge, for which we grieve,
Is for our sins a punishment
Most righteously by Heaven sent.
Let us our guiltiest beast resign,
A sacrifice to wrath divine.
Perhaps this offering, truly small,
May gain the life and health of all.
By history we find it noted
That lives have been just so devoted.
Then let us all turn eyes within,
And ferret out the hidden sin.
Himself let no one spare nor flatter,
But make clean conscience in the matter.
For me, my appetite has play'd the glutton
Too much and often upon mutton.
What harm had e'er my victims done?
I answer, truly, None.
Perhaps, sometimes, by hunger press'd,
I've eat the shepherd with the rest.
I yield myself, if need there be;
And yet I think, in equity,
Each should confess his sins with me;
For laws of right and justice cry,
The guiltiest alone should die."
"Sire," said the fox, "your majesty
Is humbler than a king should be,

And over-squeamish in the case.
What! eating stupid sheep a crime?
No, never, sire, at any time.
It rather was an act of grace,
A mark of honour to their race.
And as to shepherds, one may swear,
The fate your majesty describes,
Is recompense less full than fair
For such usurpers o'er our tribes."

Thus Renard glibly spoke,
And loud applause from flatterers broke.
Of neither tiger, boar, nor bear,
Did any keen inquirer dare
To ask for crimes of high degree;
The fighters, biters, scratchers, all
From every mortal sin were free;
The very dogs, both great and small,
Were saints, as far as dogs could be.

The ass, confessing in his turn,
Thus spoke in tones of deep concern:--
"I happen'd through a mead to pass;
The monks, its owners, were at mass;
Keen hunger, leisure, tender grass,
And add to these the devil too,
All tempted me the deed to do.
I browsed the bigness of my tongue;
Since truth must out, I own it wrong."

On this, a hue and cry arose,
As if the beasts were all his foes:
A wolf, haranguing lawyer-wise.
Denounced the ass for sacrifice--
The bald-pate, scabby, ragged lout,
By whom the plague had come, no doubt.
His fault was judged a hanging crime.
"What? eat another's grass? O shame!
The noose of rope and death sublime,
For that offence, were all too tame!"
And soon poor Grizzle felt the same.

_Thus human courts acquit the strong,_
_And doom the weak, as therefore wrong._

If it had been my family he had killed, he never would have made it off of the courthouse steps alive.

He'll fuck up. It's his nature. Then justice will be served.

Rawr! Outrage! I will post with anger! It's the rich! It's the poor! It's the republicans! It's the liberals!

With all due respect, none of you could possibly know what you're talking about until it happens to a member or members of your family. Talk is cheap, I can speak from experience.

At the end of the day, another rich kid with money for expensive lawyers has killed someone and will not be appropriately penalized for it. So I'll say to him what I said about George Zimmerman (another murderer who got away with it):

I hope the jury in your head convicts you every minute of your life! I hope the blood on your hands never washes away in your mind and that it takes you to hell where you belong!

He might not receive the criminal justice he deserves, but the court in his head is 24/7/365 and all the money in the world won't help him with that....:firedevil:

Bator, I am grieved to learn that you speak from the perspective of a man who has lost someone to the negligence of another. I would never attempt to usurp your viewpoint. "If it were me" doesn't bridge the gap either.

But we all have some skin in the justice system. We foreswear revenge in the name of justice. When a judge forces us to comply with the system, we accept his authority because justice is equal across society.

When justice is not equal across society, then the victims of such miscarriage deserve the support of an outraged public. Otherwise, the system does not even question itself, much less correct itself.

Okay, few of us are lawyers and few of us know any but the press reports of the judge's decision and any comments he may have seen fit to afford us, his subjects. But absurdity is an irreconcilable fit in the justice system.

Does anyone know if this judge was elected or appointed? He seems a bit partisan for a man whose career will flourish or wither with the electoral seasons.

The judge is a woman. She was elected. She will not be running for re-election but retiring after this term.

The judge is a woman. She was elected. She will not be running for re-election but retiring after this term.

So she really has no skin in the game anymore making it easier for her to render a horrible verdict that just screams what everyone already knows; there is no justice other than what one pays for!

I see it all the time in the courts here at home; if you can buy....I mean obtain an attorney, you'll get some justice. If you can't and go in yourself, unless you know (or are willing to learn) the nuances of the court system, you'll headed for a world of hurt. Yeah, justice is blind all right...for the right price it'll turn blind and a deaf ear too.

Shame on this judge! Shame on her!

Since affluence seems to be so important to the perpetrator, I hope the victim's families bankrupt his entire family for generations to come. That seems to be the only language some understand.

Fucking typical anymore these days. Fuck the rich.

Amen to that, brother. Fuck the New Gilded Age!

I see that a right-wing secessionist group is calling for the resignation of the (Republican) judge who presided over Mr. Couch's trial. Now, if only some cooler heads would also take the same action...

Kinda makes you want to hotwire an SUV and take it for a joyride.

They've been tested against walls, pedestrians, and other vehicles, but nobody mentions McMansions.
