"The clips are free. You charge for the service of providing them. Thank you-Justin"
Ummm...see Justin...that still violates copyright laws. You really should look up what the copyright law states before making a statement like that. According to the source at
www.copyright.org:
"What is copyright infringement?
As a general matter, copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner."
See, anytime money is exchanged in regards to someone else’s copyrighted material, it is still a violation of copyright. That is what that "publicly displayed" means. See, he is also "distributing it" for monetary gain without the permission of the copyright owners. That is a violation of the law. Actually, technically, even if you don’t charge, it is against copyright laws if you don’t have the permission of the person who owns the intellectual property. Again from the
www.copyright.org website:
"Could I be sued for using somebody else's work? How about quotes or samples?
If you use a copyrighted work without authorization, the owner may be entitled to bring an infringement action against you. There are circumstances under the fair use doctrine where a quote or a sample may be used without permission. However, in cases of doubt, the Copyright Office recommends that permission be obtained."
As I said before, I wasn't trying to be a jerk in my original post or start a flame war. I was just trying to inform the person who owns the site that what he or she is doing could land him or her in alot of legal hot water. And remember, the particular clips that he has posted are owned by major media studios that have many lawyers on the payroll who do nothing but sue people in court for just this type of thing. Also, they have very deep pockets and can to pursue the matter for a very long time.
