I am not one to bash an artist for any reason, but this artist is one i will have too. Her name is Velly-Z. She is an artist who did some great work and when i read that she was doing commissions i jump on it but now I'm really sorry for having to do this in public but you've left me with no real alternative. I think I've been very patient, but it's time to bring this to an end.

I paid you over a year ago (up front and in full) for a comic and picture commission and still you have not yet delivered. I tryed emailing you many times, the last time was on a saturday of september 25th 2010 and still nothing. Iam you had some personal difficulties from the last email you sent but Please deliver the comic and picture commissions I paid for or return the commission fee.

... I'm experiencing some serious De Ja Vu. Was it you who posted a very similar post in the art forums?

The last thread was started by an other member. I just added my voice to the topic because i am still have the same problem that he has when it comes to her not given the commission that people pay her to do.

Ah, ok.

Always, always, always do your research before giving money to people you've never really had any true contact with. Who is she, how does she want paid, has she had a bad history with non-completions, has anyone else had an issue with her etc. etc.

she still owes me a drawing I paid $50 for. I got a email over a year ago saying she is getting on it but then nothing. I have tried sending emails but to no luck.

At this point, I have to wonder if class action could be taken against her.

Most likely. She's broken a contract so she's perfectly liable. If you have any evidence proving a contract was made, you got a case.

No offense, but that is what happens when you put such an unknown on such a high pedestal so fast.

But she claimed very persuasive boobs and drew pictures that made their peepees all hard! :rolleyes

If its in writing, and it looks like you guys reached an agreement (i.e. she emailed you back 'yes, I agree to do X for Y dollars by Z date), then you do have a contract. But its such a small amount of money, there's not much to be done about it. Even if there were, do you really want to go to a court, and state on public record how the fetish drawing you commissioned didn't get done? Odds are no. I think you're out of luck. Think of it this way: how many hours of your life do you want to waste worrying about $50?

Ah, if I'm right on Velly's rates, it was quite a bit more than $50.

If you want your $200 back badly and you have the evidence to prove a contract was made, then go for it. But realistically, the best outcome would be getting your $200 back plus having your court fees paid for. I wouldn't imagine you'd receive compensation for "lack of pornographic material".

But I think the best advice here would be this:

FORGET ABOUT IT, MOVE ON AND NEVER DEAL WITH VELLY_Z AGAIN!

This isn't the first time this has happened, and I'm sure it won't be the last.

You can probably kiss that $200 goodbye. Having vast experience dealing with deadbeat models and artists, I can tell you that the notion of suing is really no notion at all. It will cost you several hundred dollars to several thousand dollars to take this person to court. Particularly if you reside in different states. I already wrote a little comment and advice on a previous thread regarding this artist. She is talented, and by all accounts, nice. However, she obviously has personal and or finacial issues that have her demanding full payment up front from clients and then not being able to deliver. Like many of these deadbeat artists, she probably wants to make good on the agreement, but is so deep into debt and or personal obligations that she figures ignoring the problem with make it go away or give her time. This even happens with professional comic artists who take commissions. I know one big name artist that took 3 years to complete a simple pencil sketch they took money in advance for. For your problem, it's too late to do a chargeback, even if you used a credit card. You could file a complaint with the postal inspectors if you paid through the mail. Best thing to do is try to keep getting ahold of her. Look for forums that she may still be active on and contact her through them. You can even try to get her contact info. She is most likely still receiving your e-mails.
