Court Tells Bavaria to Allow Wife-Swapping

BERLIN (Reuters) - Germany's top court has ordered the state of Bavaria to allow partner-swapping, dismissing complaints from residents in the conservative southern state by ruling that "swinger clubs" are not immoral.



The decision by the Federal Administrative Court marks a victory for a Bavarian man who has been fighting opposition to his swingers' club through Germany's legal system for several years.


"This is very positive for all German swingers," said a relieved Volker Erhardt, owner of Club Carat in the Bavarian town of Wuerzburg.

I'll never understand the practice of swinging, but consensual sex between adults is none of my business, so I guess the guy's got a right to operate his club, even if it's offensive to some in the community.

All I have to comment about this one is:

When I get married. I am going to be happy with my wife. I am not going to ever have any desires to cheat on my wife... ever! And I will definately not swap her!!!

I don't do wife-swapping. Never have - never will. That's because it's not my thing.

BUT

I strongly feel that you cannot legislate morality. I don't want to conform to other people's standards of what is moral and what is not. I sometimes have enough trouble living up to my own.

Why is it just called wife swapping, when the husbands are getting swapped, too? As for me, I'd never swap my wife. Unless I could swap her for Packer season tickets, then maybe I'd consider it...😉

If you cannot legislate morality then we might as well get rid of every single law we have.

Why do so many people confuse sex with love? I know the Christian church says: No sex outside of marriage, and THEY actually design all morality in our culture. They've confiscated a monopoly on morals.

I'm no swinger myself, but I happen to know a couple which goes for that. Through them and their friends' circle, I got the chance to talk to several people who are into swinging. I was quite astonished myself when I sensed the depth of love within their marriages. And they all confirmed that swinger parties really strengthened their marriages. Probably swinging also damaged other marriages, I don't know. But the crucial point is:

They exchange SEX in these circles, not LOVE! Although I couldn't do it myself (much too jealous for that), I respect them and their opinion that marriage is about love, not about sex.

I guess you have a point, Omega.

I think what I was trying to get across is that there are some laws that are enacted just so a politician can show the voters that he is "moral and upright". Some laws are enacted to protect society from predatory behavior.

In the midwest, where I live, there were "blue laws" up until about twenty-five years ago, that prohibited you buying some items on Sunday. Among those items you couldn't buy were all paper products - this included toilet paper. To me, this is an example of legislating morality. The law was enacted because politician wanted to go on record as saying people should devote Sundays to worshiping God. (Fewer people would have to work if stores were closed. All you could buy was bread, milk and gasoline.)

We have laws against murder, assault, and theft because they protect us from those who don't have a conscience.

Personally, I can see a difference.

My 2 cents... I think that love and sex are very connected. I do not feel that any couple would want the beauty that they share with one another to be exploited to other partners. I just feel like it ruins that specialness of it!
