Rape by definition is as follows:
"The crime of forcing another person to submit to sex acts, especially sexual intercourse."
If you have a tickling fetish, and tickle torture someone against their own will, it could be classified as rape, if the victim made a claim. It doesnt have to be SEX to be rape, it can be any sexual act. To the victim, it may not be a sexual act, but to the person committing the rape, it's a sexual act. It would be less harsh than if the person were to actually "RAPE" the victim, but it could still get you in jail.
EDIT: Now that I look again at the rest of the definitions for rape...
"The act of seizing and carrying off by force; abduction."
So really, just TAKING the person would be rape, even before you tickled them.
