Woman sues over flying pop cap

A Vancouver woman is suing Coca-Cola Bottling Company, claiming she was opening a 2-litre bottle of pop when the cap shot popped off into her eye. A lawsuit was filed in B.C. Supreme Court, where Dawn Douglas claimed she had severe bleeding in her right eye, her retina detached and she now has permanent eye damage. The argument is that the company failed to warn consumers of the serious risk in ordinary handling of the pop bottle. Douglas asked for special and punitive damages - no dollar figure was specified.


Ummm, I know on pepsi and Dr Pepepr there is a warning that says open pointing away from you, is coke not that suave to warn their consumers of the danger?
 
I think some people will go to ANY lengths to get money or suing anyone.

A little titbit for you: A couple of people who work in law attempted to sue some examiners because their maths exams were too hard. They said "they are using their right to sue to the fullest". No shit. Of course, they could've admitted to being intellectually challenged...

Next thing you know there will be a public outcry that every bottle or can must also read: "Contents may also be used to remove, paint, glue, rust, corrosion(especially on vehicle batteries, such as cars, boats and trucks). Failure to use this product including but not limited to its' contents or packaging, properly may result in criminal and or civil lawsuit especially if used as a weapon in any way shape or form. Please drink responsibly. Do not mix with alcohol and operate heavy machinery or drive auto or marine vehicles."

hmmm...thats about as stupid as the lady who sued McDonal's because she got burned by her coffee when she put it in her lap, that was just ridiculous, I mean how stupid can you get if you want cold coffee go to Starbucks, and who in the hell opens a soda bottle with the cap pointed directly at their eyes. Make sure it isnt shooken up DUH

Don't go by what the papers say about the pop cap story, they could be leaving some information out of the whole incident, just to make it more outrageous.


And, just to dispense the myth about the McDonald's coffee incident -- I learned this from my, formerly a lawyer, Business Law teacher a couple quarters ago...

The person who was burned in the McDonald's incident was sitting in the passenger seat of the car and was approximately an 80 year old woman. My guess is that she put the cup of coffee between her legs because the cup was too hot to hold for her fragile hands. And I don't think there was a cup holder in the car.

The burns caused by the steaming hot coffee were third degree which covered her thighs, groin, and stomach area. Again, the woman was about 80 years old. Second degree burns can give you blisters, by the way.

McDonald's had been warned before about the temperature of their coffee, and that it was too high, yet they did nothing. Their reason? Because the temperature of the water brings out more flavor in the coffee bean, even the few degrees that it is over their competitors.

Another note, it takes only a few seconds for 115+ degree coffee to seep through clothing and cause third degree burns. Even if you are lucky enough to peel off your clothes as soon as the steaming hot coffee spills, chances are you are still going to come off with some minor burns somewhere. But it's kinda difficult for an 80 year old woman to peel off her clothes in the passenger seat of a car in a matter of seconds.

The 80 year old woman won her case, hands down.


Don't believe that what the paper prints is the whole story. They are in the business of selling papers. True, the story is what people read, but the more outrageous the better, eh? Although, I can't remember if there was some sort of order that no one could say anything about the case. Could've been.
