Judge throws out $25 million lawsuit against McDonald's

The other day a judge threw out a $25 million dollar lawsuit that a family slapped against McDonald's and claimed that the fast-food giant was responsible for her diabetes , her weight problem, and her childrens's health problem.

But, according to the judge, the family did not seem to have a problem eating there 3 or 4 times a week.

The judge called the lawsuit "laughable" and an "insult to the Justice system"
 
If the judge did otherwise, it would've been a complete shock! That suit had no grounds whatsoever. Ridiculous! McDonald's is no more responsible for health problems than the tobacco companies are, and I'm strongly anti-smoking (the companies, not the smokers themselves).

Not any different than people suing the tobacco companies for cancer. We have known for 50 years that smoking can cause cancer.

Those cases should not have even been heard.
 
OK, Biggles, what did I miss? This is an anti-McDonalds site that dishes out as much crap as the jerks trying to sue the company for force-feeding them and their kids too much fatty food. I don't recall seeing anyone tied up and having food shoved down their throats in any of OUR stores. All these clowns are doing is trying to ruffle feathers and make a name for themselvs. I applaud the judge in the latest BS case. It's about time somebody showed some testicular fortitude and stood up to these nutcases.

Hell, if we could get away with suing anyone we like, I should sue the steel mills in Steubenville, Ohio for ruining my health by spewing so much pollution into the air. It's very obvious that they don't follow the filtering guidelines that are supposed to be in place. I could make a fortune. Actually, I should also sue God for having it be so foggy and holding all that pollution in. I could make a bundle there! Of course, if I'd chosen to stay KNOWING what that shit in the air did to me after a near ER severe reaction, I'D have been as responsible as they are.

It's time people showed some guts and took responsibility for their own actions instead of constantly blaming them on everyone else!

Very much agreed, Ann. Those people who are slapping lawsuits left and right do not seem to have a problem going there every day.....

"Yes, Your Honor, I went to Brand X Cafe every day, for 40 years, and enjoyed a double-double-cheesy-greasy, with salt-soaked french fries and a jumbo soda. I continued to eat there, and clog my arteries with all sorts of bad food, despite my doctor's advice, and neevermind the fact that I got no exercise. It's all the Cafe's fault that I am overweight, with high blood pressure, and a bad heart".

What should McD's or any other fast-food joint be expected to do? Should they require their customers to sign a waiver, stating that they are not responsible for their health or eating habots?

No. That's just stupid, now isn't it?

By that same logic, I can go off and guzzle a 12-pack, get behind the wheel of a car, have a wreck, and sue Coors Beer because I was drunk.

But once again that's just stupid.

Now if Ronald McDonald kidnapped a person, tied them to a chair and force-fed them nothing but big macs, fries and sodas, then the people behind this lawsuit would have a case.

But we all know that did not happen. They walked into McDonald's on their own 2 feet, placed their order, ate their meal and left.

They walked in on their own will and on their own 2 feet.

The problem is not with fast-food, but we have a Justice System, that until now, rewarded and encouraged stupidity and lack of responsability for your own actions

Next thing you know, people will be suing Hershey's for making "hyperactive children". Opps, don't want to give them any ideas, now do we?
 
Let's see, Drinking Nestle's Quik made me fat, that's a lawsuit. Watching The Three Stooges made me violent, that's a lawsuit.
Watching The Brady Bunch scarred me for life against footballs in the nose, that's a lawsuit.
Listening to Led Zeppelin and Deep Purple at high volumes when I was younger made me lose my hearing, that's a BIG lawsuit.
Watching Foghorn Leghorn when I was younger made me paranoid against large, talking, stuttering roosters with southern accents, yet ANOTHER lawsuit!

I'm calling my lawyer!!!!

Daniel Finkelstein (The Times, 31.12.02) picks up on the phenomenon of anti-McDonald's sentiment, and asserts that the company 'has no power over us at all', and that opposition just boils down to 'pernicious anti-Americanism'.

In our opening speeches in the historic 'McLibel' trial, we set out the case of campaigners against the Corporation for a full day, and I added in passing: 'I can say on behalf of both defendants there is no anti-American feeling of any kind whatsoever. The problem is multi-nationals and corporations.'

The trial became the longest in english history, a 313-day wide-ranging tribunal on the Corporation's business practices, focussing entirely on the company's effect on society, working conditions, children, the environment, animal welfare etc.

The High Court, not known for its 'pernicious anti-americanism', ruled that McDonald's marketing has "pretended to a positive nutritional benefit which their food did not match"; that they "exploit children"; are "culpably responsible for animal cruelty" and "pay low wages". The Appeal court added that it was fair comment that their employees worldwide "do badly in terms of pay and conditions", and true that "if one eats enough McDonald's food" this may well lead to "the very real risk of heart disease."

These damning rulings vindicate many of the arguments of the critics of McDonald's, and indeed the modern food industry generally. No-one should be surprised that there is growing opposition, including in the USA, to a powerful company which spends over £2 billion annually world-wide forcing its one-sided advertising on the public, including targetting vulnerable children.

There is a also great deal of community-based opposition to fast food outlets taking over local pubs and other residential sites. Mr Finkelstein should know this well - the residents of Harrow West where he recently stood for Parliament have been up in arms since 1999 against proposals for a McDonald's there. He was not elected.
