Under the rules, members who post material are responsible for obtaining any necessary permissions from the producer or deciding if the posting meets fair-use guidelines. We prohibit single split clips of over 20 MB total and any form of private file trading through the forum to reduce the risk of piracy, but ultimately it's up to the producer to contact us if he or she is concerned about the usage of paysite material.

Many producers are happy for the free advertising, especially if it's older clips that are being posted. Most older material has already been pirated and distributed through illegal P2P networks and thus has little commercial value.

So then what you are saying is the producers DO know about it, so it should be completely ok if I tell them. So then if I owned a video store it would be totally ok for me to let people sit at a table at the front of my store and sell illegal pirated movies because the onus is on THEM, to know better.

Ok then if thats the case lets then should we just see what these producers think about the situation then and if they dont have a problem with this being allowed in this forum?

If you want to, go right ahead. If it will keep us from allowing videos by someone who would rather not have them here and thus save us from possible problems in the future then you are more than welcome to do so.

As Nessonite said, you are welcome to contact any producer at any time. We do not and can not restrict that.

Your analogy to a video store is somewhat flawed. If someone is selling bootlegs outside your door, it would be quite difficult for you deny knowing about it. The onus in that instance is on both of you. You, for knowingly and wilfully allowing the illegal action to take place and them for doing it. The difference at the TickleTheater is that we do not wilfully allow any posting/sharing of material that the producers do not want distributed. Producers contact us if they don't want their material shared and we post notices alerting members that they MUST NOT post that material. If it is posted, we rely on either our own eyes, the producer's eyes (For who knows their material better?) and the eyes of other members. If found, illegal material is immediately removed.

In your analogy, illegal happenings/material is present and you know about it but refuse to do anything. That is far different from our stance that it is not allowed and that if found it is immediately removed. Going on four (Or is it five or six?) years now, no producer had found cause to become angry with us over material being posted. They know that if they tell us to remove something of theirs that it will be done.

My video store analogy does work because, according to you, if you havent received a email from every single producer on the planet telling you that they dont wan't their pay copyrighted material being posted on the forum, then it is ok for you to allow it to be posetd here. Well if i had my own video store, unless I got a notice from Steven Speilburg, George Lucus, etc etc etc, specifically telling me that it is not ok for people to share bootleg coppies of their movies then it is totally acceptable.

I guess I should notify every single car theif in the world to not steal my car, and notify every single auto dealership in the world to not store and advertize my stolen car for the theif (especially since they know its stolen) Because after all unless I tell them not to advertize stolen cars it makes it perfectly ok. Thank you! I didnt know all wrong activity could be excused with a "well i didnt get an email saying he didnt want it done."
 
This is rediculous. Your analogies don't work.

It is stupid I agree! that was the point! The reasoning of "if a producer doesn't email us and TELL us that he doesnt want his full pay clips that he currently is trying make money from on his website, posted on here for free, then how do we know he doesnt?" is just as stupid. IE my point for using that example, so you would get it. I purposely used that obviously rediculous example to show just how retarded the logic for allowing pirated material on here is.

There are full pay video clips being posted on this forum. Clips that are being sold on the producers websites for money. It doesnt take a rocket scientist to figgure out that if someone has something currently on their website that they are trying to get people to buy and make money off of and PAY FOR, that they probably wouldnt want it posted on a forum for FREE, where people would just downloaded it without paying for it. To not see this, or to pretend to not see this (because I can't possibly see how someone could be so stupid to not see this, I don't believe it is humaly possible), so to pretend to not see this is whats really stupid. And to say "the onus is on the poster to get permission from the producer" Like come on what a cop out. How many of these people posting illegal clips actually get permission. Don't expect me to believe that you dont know darn well that half of these people posting on here could give a damn about permision. Wow I can't believe how generous all these producers are by granting permisiioon for people to post these hundreds of pay clips in your forum. I didnt know there was so many generous producers. Like, give me a break!

So the whole "if a producer doesnt email us and tell us he doesnt want his current pay site material here, because we are too stupid to figgure out that a producer wouldnt want his pay stuff posted here for free if he is trying to maske money off of it" is abosolutely rediculous and the most obsurd thing I ever heard. Like come on here! Why not just be honest and say "we know know illegal activity is going on here but, we just dont give a care" As dishonest, and down right disrespectful to the producers as it is, it certainly atleast looks alot better then trying to pretend to act stupid about something so obvious.
 
We do not allow paysite clips to be posted on here regardless of whether the producer has requested they be disallowed or not. However we cannot view every clip posted nor can we be expected to know which ones are from paysites and which ones aren't. If you see a paysite clip here all you gotta do is hit the "report post" button and we'll look into it.
 
I'm still confused as to why you seem to want to make such a fuss over this. THe producers are quite happy with what we do to safeguard their IP, and have been for years. We have never once recieved a message from any producer expressing an opinion that the system in place now is unsatisfactory. I would guess that nearly every major producer, if not all, knows we exist and knows our policy.

I don't dispute your right to voice this opinion and argue it, I simply find it to be without support and reason.

Should this be true, notify us as Nessonite said. We work hard to ensure that every instance of paysite material being posted that we are alerted to or locate ourselves is immediately removed.
