Girl Flips Off Judge.. Gets 30 Days..

The Judge has the authority to do almost anything he deems appropriate.

His actions are not based upon Black letter law. Once in the position of Judge, he has a lot of discretion.

(The freedom to decide what should be done in a particular situation).

She could be charged with contempt of court or fined as she was.

The judge is neither right or wrong, the judge is merely acting within the scope of his authority.

Another judge may have simply ignored her while another judge may have been a more harsh.

A courtroom is not a place to play around. The court provides substantial justice.

It certainly is not a perfect system.

The judge must comply with the rules of law and rules of court. If not and is just allowed to do as he pleases he becomes a god and not a judge. The judge's job is to administrate and referee, not to harass young dumb high girls who get under his skin. If his skin is that thin, he doesn't need to be on the bench, period, end of story.

Yes he/she gets some discretion and can apply some interesting methods of punishment (making a woman stand on the street with a sign saying "I'm an idiot for driving on the crosswalk when I didn't want to wait for the school bus to leave" would be an example of such punishment). But he/she simply can't ignore rules of law and court and be abusive either.

That's why he got in trouble because he used his position to apply excessive punishment to her. I'm not her cheerleader and think what she did was stupid. But she shouldn't have been before the judge and still under the influence either.......another dumb decision made by the so-called justice system.

The judge is responsible for his decisions so yes, he either applies the rules of law and court to the situation and not get all personal and pissy about things, or he is DEFINITELY WRONG, and can get called on it in appeal. If he steps outside his boundaries he can be disciplined or removed from the bench, so his actions must comply to rules of law and rules of court only. Anything else can be attacked and people who should've been punished can go free. It's called technicalities.......he has rules to follow just like everyone else.

And to say "It certainly is not a perfect system" would define the understatement of the millennium! :laughhard:
 
Judicial Misconduct is hard to get handled..

Even if a judge is out of line...

It is rare that they get sanctioned....

There needs to be consequences for stepping out of line in court. That's the bottom line here.

If there aren't consequences for that, then people are just going to start firing off comments willy nilly, and not give a crap about maintaining order in the court.

That's why the concept of being held in contempt was imposed in the first place.

That being said, I don't think Judges should be allowed to abuse their power. The judge in this video was right in the sense that the girl needed a punishment for being so disrespectful, but totally went off the deep end with the actual punishment. My family's been through a great deal of court proceedings, and as all families under such circumstances, we're well aware of how crappy it is to get a judge that just doesn't like you. There should be absolutely no bias in a court of law, but the problem with that is how difficult it is to find unbiased people, let alone unbiased people that could handle/want that kind of responsibility.
